Minnesota lawmakers reject same-sex marriage ban

The Minnesota senate judiciary committee on Tuesday turned aside a proposed constitutional amendment that would ban same-sex marriage and its legal equivalents in the state. The committee didn't directly reject the proposed amendment, which has been an emotional issue in recent years. Instead, it rejected a reworked version of the amendment. The new version would have prohibited the judicial branch from having jurisdiction over defining marriage, stipulating that the legislature has the power. The measure failed on a 5–4 vote in the committee, which has a Democratic-Farmer-Labor Party majority.

The vote came after some 90 minutes of testimony on the original proposed amendment. At a packed hearing open only to ticketed observers, gay rights supporters pointed out that the state already has a law outlawing same-sex marriage and that the state constitution is not the place to deny rights to citizens.

Backers of the measure said that traditional marriage is under assault by judicial decisions around the country and that the constitution is the only way to ensure a judge doesn't overturn Minnesota's law.

Sponsors of the amendment knew they faced long odds in the judiciary committee and have vowed to keep pushing to bring the fight directly to the floor of the senate. But that body's DFL majority has repeatedly united against such efforts.

Even if it's not on the November ballot, same-sex marriage is still likely to be part of the debate in some election contests. Amendment supporters have promised to use the issue against DFL senators from rural districts, where opposition to marriage equality is generally higher.

On the other side, some suburban Republicans have distanced themselves from the amendment, cognizant of the socially moderate swing voters that they need to win reelection. (AP)"

The struggle for signatures to place an amendment on the Arizona ballot is also losing steam. A report by the Kyl panel (Jon Kyl - R, AZ) given to congress yesterday said that a Federal constitutional amendment by congress is needed to ban gay marriage before key court decisions make it impossible for an amendment to even be introduced.

I agree, although thankfully it appears that a federal constitutional admendment doesn't have enough votes to pass at this time. I believe they need a 2/3rd's majority. This is going to come up for a vote in June.
 
Funny, we've had same sex marriage here in Massachusetts for a little more than a year and we haven't been seiged with plagues, falling meteors or terrible earthquakes. If fact, you hardly hear about it anymore. Live and let live is a good motto here.

SS marriage always becomes an issue on a slow news day. It's been quiet here in Canada for a couple of months since the federal election, the new (conservative) federal govt, in particular our new Prime Minster Steven Harper has been too busy kissing GWB's arse on trade issues and the like but it's only a matter of time now that he reaches to the back burner and brings it up once again though it's unlikely now he can do anything about it now that it's law and he only has a minority government. Even if he ever gets a majority he'd be treading on dangerous waters if he tried revoking something now written in the Charter of Rights.

Never say never. What is law today can change tommorrow. In the US, the conservative Christian right is very busy trying to undo many rights taken for granted today. Many civil liberties are at risk.

I never say never but even conservatism in Canada is nowhere near as rightwing as it is in the USA. That doesn't mean there arent any, they still write to the newspapers spouting the end is near.
A key difference in the marriage debacle between Canada and the USA is that in Canada it is the federal govt who defines the term "marriage"..i.e. a man and a woman. The provinces do not, though they are free to set their own guidelines as to who and how marriages can be performed. So when the federal govt re-defined the term married to include same-sex couples the provinces had no choice but to oblige.

Prior to the federal govt redefining the term "married" here in Alberta which is the most conservative right wing province in the country they vowed to do everything in their power to stop it. When they found they couldn't do anything because they had no jurisdiction over the term "married" they enacted legislation allowing any two people, same sex, brother-sister, two friends, anyone two people to register as co-dependents and entitled to all benefits the same as married couples, just that the term married was never used. But it was too late, it was actually and still is a good piece of legislation.Britain side-stepped the issue by using this same tactic and it's believed they copied much of the Alberta legislation. Not a true marriage but basically the same thing, whereas in Canada now it is a legal in name marriage.

SS marriage is still under attack here in MA.
And the most damning thing about it is it is being done by out of state religious conservatives backing signature drives in state. They have come in state with volunteers and money and been caught baiting and switching signature petitions red handed!!! They tell people they are signing a petition to stop the sale of alcohol in supermarkets but it really is a petition to recind SS marriage!

Looks like we will be losing our conservative republican governor this next election. Hail Mary!

Just thought I would add my two cents worth as a proud Minnesotan. I've not posted on a non appliance issue before, and I am not even looking for an owners manual! Oh boy!
