OMAHA, Neb. - A Kansas woman accused of violating Nebraska's flag desecration law two years ago filed a lawsuit Wednesday against more than a dozen officials, including the state's governor and attorney general, whom she alleges are trampling on her rights.

The lawsuit filed on Shirley Phelps-Roper's behalf in U.S. District Court in Lincoln argues that Nebraska's flag law and another state law that restricts protests at funeral sites should be declared unconstitutional and barred from being enforced.

Phelps-Roper is a member of Westboro Baptist Church in Topeka, Kan., known for protesting at military funerals to express the belief that U.S. troop deaths are punishment for the nation's tolerance of homosexuality. She alleges that officials are misusing their powers and applying the laws inconsistently, discriminatorily and in violation of her and her fellow church members' right to free speech.

"These steps that we're taking are necessary because that federal court, called the last refuge of the oppressed, is either going to do right or they're going to bring more thunder on your state and on the nation," she said Wednesday.

Church members planned to hold several protests Wednesday in Lincoln, Omaha, Bellevue and Papillion outside the state Capitol and offices of other officials named in the lawsuit. That list includes Gov. Dave Heineman, Attorney General Jon Bruning and several law enforcement officials and prosecutors in eastern Nebraska.

Bruning's office wasn't certain if attorneys for the state had seen the lawsuit yet and couldn't immediately comment.

Nebraska's law against flag desecration bars intentionally "casting contempt or ridicule" upon a U.S. or Nebraska flag by mutilating, defacing, defiling, burning or trampling it. State law also prohibits picketing within 300 feet of a funeral or memorial services. The law applies one hour before services begin and two hours after they conclude. Violators of either law face a misdemeanor charge.

According to the lawsuit, church members have been involved in more than 40,000 protests across the country in nearly 20 years. That includes about 250 to 300 protests in connection with funerals and memorial services. Church members say all have been conducted peacefully and lawfully. The group began protesting at military funerals in 2005 - a year before Nebraska's picketing law was adopted.

It was while protesting at the funeral of a National Guardsman in Bellevue in 2007 that Phelps-Roper was arrested and subsequently charged with flag desecration and other crimes after letting her then-10-year-old son stand on an American flag. Authorities also said she wore a flag as a skirt that dragged on the ground.

The case is pending in Sarpy County after Phelps-Roper lost repeated attempts to get the charges thrown out. Sarpy County Judge Todd Hutton and the Nebraska Supreme Court, who were among those to reject her requests, are listed as defendants in her lawsuit.

Her lawsuit claims both laws discriminate based on the content of the group's message and fail to reflect any "legitimate, compelling or other government purpose or interest."

Since the 2007 incident, Phelps-Roper said officials beyond those in Bellevue have used the laws to threaten her and other church members. She argues that their actions have stifled her right to free speech and created a chilling effect for those who want to use the flag to express themselves.

The lawsuit also seeks to declare unconstitutional and bar enforcement of the city of Bellevue's practice of issuing permits to hold protests within city limits.

Oh Boy!

I've dealt with this group before. They came and protested at my 3,500 student undergraduate college because the drama department put on a play that involved a homosexual character. This church group is completely nuts and their preacher (Mr. Phelps) is one of the most hate-filled individuals I have ever had the misfortune of encountering. I believe the church may be officially classified as a hate-group, but I haven't checked for some time, so don't quote me.

They do a large amount of fund raising by suing anyone who crosses them and, unfortunately, they frequently win on technicalities. Churches do many good things for many people, but this one is just a hate group hiding behind religion. There have been many hate-filled religious groups over the years, but this one is the most offensive, misguided, and evil ones I have come across to date.

This church, its preacher, its members, and its legal department are all BAD NEWS. STAY AWAY from them. Don't talk to them, don't try to reason with them, and if they come after you, just leave. Tangling with them only gets them more notice and they are likely to sue you.

I'm neither gay, nor a Christian, and I don't believe in Hell and I don't often wish ill of anyone, but... I wouldn't be at all upset to hear of some tragedy befalling this institution, ending its reign of hate.

It is difficult for me to comprehend how this group of people can hate this much, and why did they choose sexuality?

The "Church" leader is Rev. Phelps. Legal department: His Daughter, Shirley Phelps-Roper.
The Congregation: Their extended In-bred family. I think the total is about 30. They were sued back east and have a $10 million judgement against them.

Added crazy family trevia: Shirley Phelps-Roper is high up in the Kansas Department of Corrections. This way she gets to make sure bad people are in hell.
 
These people are mentally ill!

Thus, they should be institutionalized in some nice little place where they get a warm bed, three square meals and baskets to weave. The only Constitutional right that exists for these people is the right to reciprocal protection. We protect ourselves from them and them from themselves. Doesn't that make sense?

I am of the opinion that the de-institutionalization of the mental health system has much to do with all this religious craziness that's swept over the US in the last 30 years. In fact I reckon they should commission a study into this, 'cause I can definitely see a co-relation.

A young man had died, serving the US in the illegal war in Iraq, started by shrub.

A group of Hell's Angels' motorcycles suffered breakdowns just after the funeral procession passed on the only road to the cemetery where he was to be interred.

Sadly, every available state trooper, county sheriff and local police were required to help the motorcyclists get their machines going again.

So sad - all those cop cars blocked access to the funeral for the entire ceremony.

Good news, tho' - they were able to get the motorcycles running again right after the funeral and, there being so many cops, sheriff's deputies and troopers, all the folks leaving the funeral had an escort right past where Phelp's assholes had tried to gather to protest.

How strange that all those motorcycles broke down at the same time and how fortunate that all those cops were there to help them...

These christianists are truly horrible people. What on earth reason do they have for hurting the parents, family and friends of young men and women who gave up their lives to serve their country?
 
Fortunately the Phelps infestation doesn't seem to make it out to the SF region very often. I have seen Mrs. Phelps on a news program and she appears to be one nasty bitch. Sorry for the language, but that's pretty much what she is.

She and her family are just as bad as the White Power creeps (also profiled on a news show) who raise their children to believe in Nazi dogma etc.

My impression is that Phelps and the other creeps are seeking attention for their demented ideas. They aren't happy unless they are pissing normal people off. I agree it's best just to ignore them - walk away, shut the door in their face, whatever it takes to convey the idea that they really don't exist in our world.

I think the Phelps clan are the best friends we've ever had. Seriously, how many Americans, when they see this kind of brainless and vile hatred, think, "Gee, these people really have a point?". Compared to countless thousands of Americans who're utterly repulsed by it.

So let them protest. The louder and more vile, the better.
