The California Supreme Court will hear arguments today on whether Proposition 8, the anti-gay-marriage initiative, should be upheld and, if so, whether the marriages of an estimated 18,000 same-sex couples should remain valid.

This is going to be interesting, the court has 90 days to issue a ruling, but it has been suggested that the decision has already been decided and they could rule as early as this week. A few weeks ago both the CA state senate and CA state house had passed resolutions denouncing Prop 8 and asked the court to overturn it. What is really interesting here is that the Christians are threatening a recall vote of any Justice that votes to overturn Prop 8 if it is indeed overturned. They are literally threatening these judges with their jobs, have you ever heard of such blatant abuse?

Strap in everyone, its going to be a bumpy ride no matter what happens.
 
On a more serious note...

I agree with you Robert. It sickens me to think of all the energy and resources religious groups have put into preventing loving couples from being married. It just blows my mind that with the housing crisis, unemployment, and all the other problems we are facing, this is what they choose to target.

What sickens me is that if these groups had put that much energy and resources into laws requiring that financial institutions observe the Bible's exhortations against the sin of usury, this nation might not be in the financial mess it's in now.
 
I wonder if they could do it the way the Supreme Court of Canada did by ruling in the Charter of Rights, your Constitution, sexual orientation must be "read into" all provisions regarding equality under the law. "Read into" meaning the actual wording of the document doesn't change but the court has ruled effectively it is to be considered as being written-in henceforth in every way and cannot be challenged.
 
After hearing the oral arguments today, I'm not getting my hopes up that Prop 8 will be thrown out.

Apparently our state Supreme Court doesn't understand what an unalienable right is, or understand what their job is.

I kept waiting for someone to ask the court, "If Prop 8 had stated, "Only marriage between a man and a woman who are over five feet tall is valid or recognized in the state of California", or, "Only marriage between two men or two women is valid or recognized in the state of California", would you find it easier or more difficult to throw this proposition out?"

No one asked.

This might be the first recall of Calif. SC justices. However in 1986 Chief Justice Rose Bird was the target of a conservative opposition campaign because of her opposition to the death penalty. As a result she was not reconfirmed and lost her seat on the court.

A reconfirmation challenge would probably be the route that anti-gay rights forces would use on the current court.

I appreciate the efforts of organized religion in political matters. I would also appreciate it, if they could back, the cost of their agenda, with TAX money. The U.S.A needs the money and i am sure in the interest of organized religions agenda, that they would like to do the "right thing" and contribute to the tax base.. Because it's the "right thing" to do. Organized religion does not respect separation of Church and State, just look at the hateful money they injected into prop 8. Just think if 33% of that went toward the National Deficit.
