Hey,
I just read your info a little closer.
If it was sold as new, then it had to be protected by warranty as new. If it turned out to be other than new, and Dell provided you with proof, Wal-Mart should have (maybe MUST have) either covered it under the extended warranty, or offered you a refund.
On a similar note, I do enjoy the savings by buying "open box" goods! I bought a laptop at Best Buy that way, and further negotiated for a leather laptop bag that I'm still using for the current laptop. Our microwave was bought open box, as was the big BTU a/c we use downstairs (negotiated down more as well!)
