I saw that yesterday. I'd be fine with this although I'm not sure it will stand up to an eventual constitutional showdown because of previous separate but equal rulings.

I suspect the final ruling would depend on Paul Stevens. We have several justices who play fast and loose with the US Constitution, Roberts has proven to be nearly as incapable of true conservative judgment as we had feared.
Still, living in Europe, I have learned the value of separating the two. Let us have the civil rights we deserve as free humans, marriage by those who are not bigoted haters and let the christianists continue to rub blue mud into their bigoted belly buttons. Eventually, even the Catholic church had to accept that the earth orbits the sun and not vice-versa...

I don't think the problem was heliocentrism vs geocentrism as much as it was Galileo's ego vs the Jesuits' ego.
