We just received a letter today from a lawyer saying that we have to be moved out of our house by May 31st because it will be demolished on June 1st. I can't believe it.
 
Get your own lawyer,

one who is experienced with tenant's rights. You may well have to move, but you might be able to move more on your timetable than theirs.

I have three months, and I won't be paying them rent if I have to move or we won't be able to afford a new place.

I am so sorry to hear this. It happened to me, about five years ago. It's very inconvenient and causes a lot of upheaval. I'm sorry you're going through this.

What's odd is that the house is being demolished. Are they planning to build something else there? Or is this related to the incident with the kitchen ceiling - as in, cost-to-repair more than they want to spend?

Again, you have my sympathies. Been there. Done that. Not happy about it to this day.

Seriously, this seems grossly unfair; I am a landlord and I can tell you that any such notice here would have to include a stipend of some kind to assist with moving and relocation expenses. This sounds kinda fishy - did the landlord have the property up for sale?? A trip to the local registry office will confirm that. If the landlord sold the property and the new owners are planning to demolish it and build a McMansion, you should be protected by some form of tenants rights law. The advice to find a lawyer experienced in this kind of matter is sound and I hope you can find someone.
 
Jim, in many states, tenant agreements are month-to-month, or convert to month-to-month after an initial lease term. If that's the case in your state, don't be surprised if the 90 days notice they gave is all that's legally required to make you move out.

The good news, if there is any, is that it's still very much a buyer's/renter's market out there. Lots of inventory and rental rates are low.

Maybe the Universe set the plan in motion to move you to a home with harvest gold appliances and a warmer place for your Maytag to reside.
 
The house needs new siding, windows, doors, the ceiling, water heater for the kitchen, new floors in the bathroom so it's probably cheaper to tear it down. There is a lot of beautiful wood on the 2nd floor, and several built-in wood cabinets on the 1st and 2nd floors, so hopefully Habitat for Humanity will rescue it before it's tore down.

Don't worry about the mixer and saucepan, where ever I end up moving I will have my harvest gold kitchen that you can count on. The Maytag definitely needs to be in a warmer room, poor girl is slow sluggish at the start of the cycle, this can't be good for her either.

It's 50/50 I upset about moving and that a old home that still has life in her will be demolished. Makes me sick to my stomach.

My neighborhood was started in the late '50s, so far ten of my little old friends have been buldozed, in a community that has a homeowner's association and a lot of caring owners. I'm hoping to become a better one when I get my personal spaces back. Three were replaced with a convenience store and gas station, the other seven or more are just empty lots. And at night, the criminal element comes from the other side of the main drag to scope out the vacant houses. Three times a month in the wee hours, we have a helicopter and searchlights. So much for retirement.

Is there ANY way that you might be able to take the amount you were paying for rent and pay the same amount as a monthly mortgage for a small house in the area? Just askin', as I don't know your area and this is sometimes a viable option. There are lots of new buyer programs out there. I just had a quick look at Realtor.com and there are a few non-condo listings there for under $80K (didn't look at details, just sorted price low to high - link included).

How did you recieve the letter? Regular dropped in the mail? Or was it registered/certified? Signature required? In WA, unless documents are served with return notice, they are not considered due notice. Proof of receiving the notice is required.

Jeff G will correct me if I'm wrong, but around here I believe you can stop paying rent and still have 90 days in your place before they can legally throw you out. If that's the case where you are, I'd stop paying rent right now.
 
A savvy landlord will screw your credit rating/report.

If you have laid out (in advance) two months rent or two month security, you can say you are applying that towards the rent.

Newton's Laws of Thermosdynamics state that for each and ever action in life there is an equal and opposite reaction. Just be sure you understand what the repercussions are and be willing to pay a price for them (i.e. for your actions).

In the vernacular: No one gets screwed without making some type of noise or protest. That includes you and your landlord!

My partner and I are small time landlords. Make sure you read up on your states landlord and tenant regulations. They vary so much that's all you can do.. And like Toggles says.. you can ruin your credit by not paying just because you're in a huff.. We report any such things to TransUnion. Might not get our money back but then the ex non-paying tenant isn't going to get a loan or credit or possibly their next rental. We do credit checks on all prospective tenants as well.

I don't think so Toggs, I think the house just needs to much work done on it and he doesn't want to pay to have it done. The concrete company next door could have made him an offer so they could expand, or he might need it for his company as well. I actually received two letters one via regular 1st class mail, and one that was sent to the post office that I had to sign for.

My roommates mother is wanting to move in with us when she sells her trailer. I don't think there will be a problem with the three of us finding something.

Finding something is EASY, surviving the epxerience, maybe not.

oh child RUN RUN RUN for the hills. The female of the species always believes itself to have superior processing abilities (I won't call it thinking) over males, and will proceeed to take charge bit by bit. Make sure the rules are CLEARLY established right up front. For your own sake. :-)

I'm with Steve as well. Having his mother move in with you is going to make this whole saga of having been given notice and moving out look like a picnic. Run! Run for your sanity, and your quality of life.

Yes, I have serious misogynist tendencies but the average male doesn't have to share those tendencies to see that in this situation, three is NOT company, it's crazy.
 
She's really a very nice woman, (very opinionated), and won't take crap from anybody. She's here almost every other weekend. The on major change I see is cooking, she's diabetic. She's slowly loosing her eyesight because of the diabetes. Her husband is a total ass, he won't do anything to help her out financially, almost refuses to take her anywhere unless it's to get something he wants.
 
Get the foreclosure paper. From personal experience, when we found our old 1953 house, it was not online, older realtors and the clientele they have established are often not impressed with computer skills. Our house was listed in a little, local, free newspaper. We stopped for gas and a coke,and ended up with one phone call, a handshake, and a buyers agreement. Best of luck to you alr2903
