just back on the drawing board. We presented to a Buyer for a large Dept Store Chain in Sept. We got rejected on the box size and price point. So we are redesigning the box and hitting a lower price point. Its a lot of work but it was good criticism, that will make a better more sellable detergent.
Also the manufacturer backed out on me as I am too small, I have found another manufacturer that I am talking too so that too is starting all over again.
Also - in the same week by the way- the patent office got back with a final rejection of my application!! The lawyers emailled me on a Friday afternoon of all times!!!
When I finally got a hold of my attorney on Monday she calmed me down and said Jon , its the Federal Govt, Final Office action doesn't mean final action !! So she explained while she couldn't guarantee a patent she told me how the process really works-Here goes:
The Patent Examiners are a union. The Office has a ruling and point system to insure poor patents dont' get passed. On this system everytime a an application is rejected the Examiner gets another point. This is the second time we have been rejected. There are three levels of rejection. We are now headed into our third level. Once an Examiner hits the points on the third level they get their highest pay grade for the application!! Beginning to make sense ?? It costs $$$ to keep responding BUT I've already spent 10x$$$ so I have no choice I am in chute so to speak!
What is interesting is the two patents the examiner cited had nothing to do with my patent application and at the time I was scratching my head but now the lawyers clarified and said they have to present something to create a rejection.
So the upshot is we are still pursuing the application to the third level, redesigning the box and getting a new manufacturer on board. Inventing the stuff was easy compared to getting it to market!!
The next buying cycle for stores starts in February so this has given me some breathing room.
